Listenix is a cloud-based audiobook storage and playback service. We provide secure cloud storage for your legally owned audiobook files, allowing you to access and stream your audiobooks from any device. The service also supports local file storage and streaming from external sources like Dropbox.

What We Sell: We sell subscription plans that provide cloud storage space for your audiobook files. Subscriptions are billed monthly and provide access to cloud storage, cross-device synchronization, and all playback features.

2. Account Registration

Account creation is optional. You can use Listenix without creating an account to access free features like Dropbox streaming and local storage playback. An account is only required if you want to use cloud storage features (coming soon) or subscribe to paid plans. If you choose to create an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3. Subscription Plans and Storage

Listenix offers the following storage plans. Note: Cloud storage features are currently in development and coming soon. Currently, all plans support local device storage and Dropbox streaming.

• Free Plan: Free access to local storage and Dropbox streaming. Cloud storage coming soon.
• Starter Plan: $2.99/month - 50GB cloud storage (coming soon), plus cross-device sync, chapter navigation, and offline downloads.
• Pro Plan: $4.99/month - 100GB cloud storage (coming soon), plus all Starter features and premium support.

Storage limits will apply to files stored in your cloud library once cloud storage launches. Local device storage and external streaming sources (like Dropbox) do not count toward your storage limit. We reserve the right to modify plan features and pricing with 30 days' notice.

4. Your Content and Ownership

You retain full ownership of all audiobook files you upload to Listenix. By uploading content, you represent and warrant that:

• You own the audiobook files or have legal rights to use them
• You have not obtained the files through illegal means
• Your use of the files does not violate any copyright, trademark, or other intellectual property rights
• You will not upload content that infringes on the rights of others

We do not claim ownership of your content. However, by uploading files, you grant us a limited license to store, process, and stream your content solely for the purpose of providing the service to you.

5. Acceptable Use

You agree to use Listenix only for lawful purposes and in accordance with these terms. You agree not to:

• Upload, store, or share copyrighted content without authorization
• Use the service to distribute, share, or make available audiobooks to others
• Attempt to reverse engineer, decompile, or hack the service
• Use automated systems to access the service in a way that could harm or overload our systems
• Upload malicious software, viruses, or harmful code
• Violate any applicable laws or regulations

6. Payment and Billing

For paid subscription plans:

• Subscriptions are billed monthly in advance on a recurring basis
• Payments are processed through secure third-party payment processing services
• You authorize us to charge your payment method for the subscription fee each billing cycle
• Subscription fees are charged automatically each month unless you cancel
• If payment fails, we may suspend or terminate your subscription after reasonable notice
• You may cancel your subscription at any time through your account settings or by contacting support
• Upon cancellation, you will retain access to your cloud storage until the end of the current billing period
• No refunds are provided for partial billing periods after cancellation
• Price changes will be communicated at least 30 days in advance

7. Refund Policy

We want you to be satisfied with Listenix. Our refund policy is as follows:

• 30-Day Money-Back Guarantee: If you're not satisfied with your paid subscription, you may request a full refund within 30 days of your initial purchase or subscription upgrade. This guarantee applies to your first subscription purchase only.
• Refund Requests: To request a refund, contact us at support@listenixplayer.com with your account email, subscription details, and reason for the refund request. We will review your request and respond within 5 business days.
• Processing Time: Approved refunds are typically processed within 5-10 business days. The refund will be issued to the original payment method used for the purchase. Refund processing times may vary depending on your payment method and financial institution.
• Subscription Cancellation: If you cancel your subscription mid-billing period, you will retain access until the end of the current billing period. No prorated refunds are provided for partial months after the initial 30-day guarantee period.
• Plan Changes: When upgrading plans, you will be charged the prorated difference immediately. When downgrading plans, you will receive a credit for the unused portion of your higher-tier subscription, which will be applied to future billing cycles. No refunds are issued for downgrades.
• Free Plan: The free plan does not require payment and is not eligible for refunds.
• Non-Refundable Items: Refunds are not available for subscription renewals after the initial 30-day period, unless required by law in your jurisdiction.
• Abuse Prevention: We reserve the right to refuse refunds if we detect abuse of the refund policy, such as repeated subscription and refund cycles, or fraudulent activity.

• This action cannot be undone

We reserve the right to delete accounts that have been inactive for extended periods (typically 12 months or more) or accounts that violate these terms.

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from service interruptions.

10. Intellectual Property

The Listenix service, including its design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the service without our express written permission.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

12. No Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free, or that defects will be corrected.

13. DMCA and Copyright

We respect intellectual property rights and will respond to valid DMCA takedown notices. If you believe your copyrighted content has been uploaded to our service without authorization, please contact us at support@listenixplayer.com with:

• Identification of the copyrighted work
• Location of the infringing material
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

14. Changes to Terms

Your continued use of the service after changes become effective constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the service and may cancel your subscription.

15. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time by deleting it through the service interface or contacting support. Upon termination, your right to use the service will immediately cease, and your data will be deleted as described in section 7.
